Posted October 13, 2018 07:05:00A new lawsuit filed by a father and son seeks to block a California judge’s ruling that will allow them to get guardianship over their 6-year-old daughter.
In a statement, the lawsuit, filed Monday in federal court in Santa Ana, said it would file a request for an injunction that would prevent the judge from enforcing the orders in his order.
The attorney general’s office said in a statement that it was reviewing the lawsuit.
The California court will hear the case next week.
Last week, the father and the son were granted guardianship in New Jersey by a federal judge who had dismissed the lawsuit against them.
The family of the 6-month-old girl, who was born in December, sued to get the order reversed after the judge said the family was being denied due process.
A court spokeswoman said Monday the case would be referred to the U.S. Attorney’s office for possible criminal charges.
Last year, the family of a 12-year old boy who was taken from his parents and placed in foster care sued the state of New Jersey for allegedly failing to care for him, according to the Associated Press.
